Zeev: I agree with your view that Hitachi must prove that the technology was "in the public domain". I am no experts on patents, but if I were Hatachi I would be worried about trying to establish that something so esoteric (to the common man) had reached "public domain" status prior to Rambus' filing. It is a dangerous game and Rambus, with patent in hand, will still be able to argue, I believe, that anything which may have slipped "into the public domain" is still violative of their intellectual property, the quality and uniqueness of which was honored by the patent office. I am still betting settlement on this whole situation....maybe not a huge win for Rambus, but a win nonetheless. BWDIK.
