I believe MSFT probably believes that the remedy determined by the judge will not be as bad as a negotiated settlement with the company. Furthermore, the appeals courts
are friendly to the MSFT case and will only strengthen their resolve to overturn the Jackson ruling...


I fully agree with your speculation. Appeals courts are usually more likely to correct overly emotional judgements. In the meantime the DOJ really wants to settle, but has time to pick away to get more goodies. Kind of like a burglar taking his time sorting through your belongings , but justifying his act because of the social injustice he has suffered.
