Even with some states possibly taking a hard line against the company, they could be subject to peer pressure; ie other states and the DOJ. To go on with the legal action without the support of the rest of the parties, would be foolish. That is why I am still confident MSFT will settle and the states holding out will be forced to join in. Also remember that the conduct of MSFT will be monitored only wrt to Windows consumer version (98 and Me). I think MSFT can live with severe terms in a settlement.
