Excellent find, Ken. The issues raised are not the least bit surprising. If I were I CLEC, I'd be screaming too, but if I were SBC, and I were spending $7B on a capital improvement program, I'd be designing my facilities to provide as much competitive advantage for my investment as I would be able to. The question is whether SBC is violating any FCC regulations in their design and rollout strategy, expressed or implied.

Also, its my understanding that HDSL will be provisioned through these neighborhood gateways via a switched virtual circuit for video-conferencing needs at speeds comparable with a T1, (1.5M bps up & down) So, as a consumer, if I desire a symmetric connection, I'll be able to get one on a switched basis.
