"in its discretion must" is a joke. The DC has discretion, but unless it has a really excellent reason it will be reversed by the CA. No DC likes to be reversed, and in order to avoid reversal it "must" bend over backward to grant the stay.
As for the Democratic plot, you must have enjoyed the idea of Joel Klein sitting down with Jim Barksdale in his home and plotting their legal strategy to screw over Microsoft.
Everyone in business does very bad things. A CID is a fishing license based on no more than mere suspicion. If the DOJ goes through your private papers they will find something they want to sue about. Count on it.
