The biggest risk was over this past weekend when no one knew for sure what Jackson would do. Now that it's known the risk will diminish with time as long as the judge is willing to wait and the negotiations continue. Extending it 10 days would mean they are getting closer to settling a very difficult and complex deal while moving further and further away from the judge's verdict.

If they wanted to split the company they wouldn't evening be talking right now!

My opinion MSFT would be smart to set up a huge ($4-5 billions) fund to allow all who win law suits against them to draw from. Let the vulture's fight over what they can get and not tie up MSFT in the courts.

Of course there is always the possibility that the talks will stop or stall and that will cause a selloff below 100.
