My thoughts on why DOJ and MSFT are likely to settle in the near future:

1) Jackson has put off releasing his ruling. He wouldn't have done this unless the parties asked him to and represented that they are making progress on a settlement;

2) Everyone knows Jackson will be ruling against MSFT and everyone knows MSFT will appeal. Jackson's decisions have a pretty poor record in the appeals court.

3) DOJ has to have some concerns about a George W. Bush victory in November. A Bush win raises the prospect that the administration will have less interest than the Clinton administration in pursuing the case. Klein and Reno will be out looking for jobs for sure.

Now's the time for DOJ to get whatever concessions out of Bill and Co. that it can wrangle. I'll go out on a limb here and say the case will be settled in the near future.
