A friend of mine got 2 allocations (50 each) on OTGS from the efolks, he shorted 100 from fbr yesterday at 49 or so ... He told me the efolks will let you short most of the stocks except their own IPOs, so they will not let you short OTGS but they let you short in odd lots fbr on the other hand will only let you short round lots ... I think edreyfus will not let you short odd lots either and forget datek, they will not let you short the IPOs ... I have to start looking into shorting it from another broker, even though I haven't get any from the e*folks this year I don't think there will be any lawauit about the no flipping, you know the rule, and if you still want to play the game ... just like any brokerage can set rules against which stock you can margin
