Jay, Prophet, Aus & Thread:

The decision was posted on the court docket yesterday. I tried to obtain it last evening but I think it was being posted as I was on line through the PACER system with the court. Checked it first thing this morning and there it was. The decision was issued by J. Breyer on 3/28/00 by way of memorandum & order - this means a written decision. I'd love to see it but it may be sealed. I'll make inquiry at the court clerks but I would hope for a PR before I get it with the details.

Is it appealable - everything is with enough money. However, SNDK can probably ask for injunctive relief in short order. And they may request a bond if memory serves.

Since the Lexar IPO is coming in about 2 weeks, lets hope for a good PR shortly. If the decision is how I read it, IMHO the Lexar IPO is probably in jeopardy.
