My understanding of SNDK's legal machinery and SanDisk priniciples in general is that their approach to the submission of press releases is well-planned and deliberate. They usually make public statements when they feel a material event has transpired. For example, there was a lot of clamoring for the PR department to submit a response to all the hype surrounding the IBM microdrive when it was originally introduced. Every time IBM made some claim SNDK investors apparently asked for a retort or rebuttal. SanDisk just does not operate that way. This is why you will notice that press releases are submitted only after great forethought. Product announcements, new hires, OEM partnerships and the like are subject to less filtering.

I did receive a correspondence from the legal department about 2 weeks ago. Currently there is no mechanism for routine updates regarding the Lexar matter. In fact, seeking guidance through publicly available documents is perhaps the best mechanism for remaining current. In this regard Mike has provided a great service to the individual investment community represented on this SNDK Thread. The mental exercises which have followed here are of great interest and, in fact, I find them educational.

If SanDisk's legal counsel feels that there has been progress made in the Lexar case that is material I would anticipate a press release. With earnings being a less than 3 weeks away they may postpone any statement until that time.

I am breaking a cardinal rule here by posting an e-mail from my niece that I received a short while back. I think the enthusiasm of mp3 is palpable in this letter. Please forgive any grammatical errors; English is her second language.

Dear Uncle Ausdauer,

Thank you soooo much for the MP3-player! I received it yesterday and it was
a wonderful surprise! I absolutely love it!

I have used this huge Walkman before and listening to tapes really sucks,
you have to rewind or forward forever to find the right song and the sound
isn't too good. Now I can brag in front of all my friends with this tiny,
really cool MP3-player. It's got great sound and it's very neat. I love
downloading MP3-songs since you can find all the songs you want. Per will
help me install the software, converting the tunes to MP3-format and load
them into the I-JAM.

I will have the I-JAM with me wherever I go now and I have a feeling I will
get "addicted" to using it. :)
It was very sweet of you to get me an MP3-player, I am extremely happy! It
feels like I can't describe in words how happy I am, you should see the big
smile in my face instead! :)
