gerard, I am sure that they can in certain cases. Last week a fellow was charged with a felony for posting a press release mock up on the Yahoo! LU thread. Of course it remains to be seen if the gov't can actually establish that anyone in their right minds would take the posts on a Yahoo! thread seriously. What you have to realize though is that just because you don't like a particular opinion doesn't make it 'fraudulent' or actionable. The fact that the SEC acted swiftly certainly supports the thesis that any fraud in the ECNC case came from the promoters on the long side. Contrary to assertions by some on this thread, the SEC does not suspend trading because they got a tip from a short seller, or file cases to 'save face'.

I do wonder why you would refer folks to a post making fraudulent accusations (RB #92831) if you disapprove of such posts. That post was what I was referring to as being pulled from thin air.
