I'm not surprised. Bill Gates always thought he was beyond the reach of the law. He has repeatedly lied under oath when questioned about MSFT's objectives. One aspect of the settlement negotiations that most people are overlooking is that by themselves the judge's findings of fact mean nothing in other cases. However, if the judge next week issues conclusions of law holding that MSFT engaged in anticompetitive conduct, that judgment can then be used as res judicata in the scores of private antitrust actions that were filed against MSFT after the judge issued his findings of fact (despite any appeal by MSFT). The bottomline is that by refusing to settle MSFT will be exposing itself to tremendous collateral damage from the private suits. MSFT better started setting aside a multi-billion reserve to pay off legal judgments.
