lurker:

It would appear that Judge Jackson's ruling could initiate
follow up civil lawsuits immediately. The question is can this decision be used in the lawsuits even if it is appealed by MSFT? If the ruling can be used during the appeal process
MSFT is going to be sucking some wind and makes their lack
of offering-up a reasonable settlement to DOJ even more
perplexing.

I wouldn't be so happy to see this go to appeal if the appellate court hadn't already exhibited a very different perspective than TPJ. Now I can understand the anguish of those holding bullish APR option positions and I understand the glee of shorts. For those long the common, I think the most sweat poetic justice would be an appeal decision that is less onerous than what MSFT offered Joel and his running dogs (states AGs).

If there's a MSFT victory on appeal, how would this ensue?
I am not a lawyer, so I don't know. However, I would guess that a ruling against msft would open the floodgates to lawsuits that would be proceeding while the appeal process was going on. That could take years. I doubt if the market would wait around to find out who wins in the end, with so many other companies to invest in that are not tied up in lawsuits. The only ones who are going to make any money, and it will be a bundle, are the lawyers.
