Liberal administrations have a tradition of being anti-big business. Conservative administrations have a tradition of being pro-big business. This, of course, is a simplification and is also not always true.

Since the Department of Justice is part of the Executive branch and therefore under the control of the President, it's possible that a conservative President could order the DOJ to settle on more favorable terms or, theoretically, even drop the case. Obviously the case won't be dropped at this point and the states would continue it even if the DOJ did drop out.
