Bill and All: It seems that MSFT made the necessary effort to settle this thing but the states and DOJ could not agree on terms of agreement. The thought of getting 20 disparate opinions to congeal on a reasoned settlement seemed unlikely especially due to the political (non-judicial)nature of this case. I would presume that Posner's frustration is aimed at the fact that the plaintiffs could not get their stuff together. This is a slam dunk for MSFT on Appeal. The DC Court of Appeals has upended Jackson every time in these MSFT matters. This really is an embarrassment for the DOJ. JFD
