The more baroque and cobbled-together any proposed "remedy" the more likely it is to be struck down on appeal. The great thing about the judicial process is that as things shift to the appellate level case law and precedent will take over from the political ax-grinding of the trial stage. It seems clear from Posner's remarks and the MSFT CC that DoJ and MSFT would have reached a settlement were it not for the meddling of the state AGs. One of the outcomes I would expect from this case going all the way to the Supreme Court would be a severe curtailing of the states' abilities to engage in antitrust actions. It seems obvious that such matters belong in Federal jurisdiction precisely to avoid the sort of circus atmosphere seen in this case.
