Charles, I think MSFT must have analyzed the whole situation. Should they have given in to the government demands and die a slow death that preserved shareholder value in the short term but put the company at a major disadvantage in the long term. I bet they factored in the private lawsuits in their decision.

I don't doubt that they had shareholders as the number one reason for not doing the deal.

I was starting to doubt an agreement was possible after hearing of MSFT's proposals. They sounded good but raised questions such as--when new features such as voice recognition technology is added to Windows, will they be forced to charge a separate amount for this OR would they have to decrease the price of the base operating to maintain a constant price. The government might be dictating everything and that could be too costly in a fast moving competitive environment. They could be too much of a disadvantage in the consumer market.

BTW--They can offer to split up the company any time they feel appropriate and I bet the government would go for it in a second. That would make the DOJ/AGs heroes. MSFT can offer to do it the way it would preserve shareholder value.

Charles you have to believe a good 10 or so points are from investors believing there will be a settlement. So now what will happen? As I said, let's watch the "fur fly" on Monday.

My fear is that initially the NASDQ will be brought down as well.
