I think it's a separation of powers thing. The Justice Department brings the case, but they can't act as judge, jury or executioner. So while they can ask for a remedy, they can't impose it.

I stand corrected. Washington Post reports that the next phase is a penalty phase, "set to start as soon as next month." So the agony will continue.

Did you see Gates and Balmer last night at their news conference? They both looked like someone shoved a red hot poker up their you know what and I detected a little fear in their voices (g)
