The difference between QCOM and MSFT is that QCOM will learn (and, in fact, is learning) from MSFT's abuses. Witness the recent agreement between QCOM and MOT. Each side gave a little. QCOM has the right and will continue to have the right to protect and build on its patents. They will have to be careful not to "bundle" their patented products into weak structures such as MSFT did with its browser, for example.

I wish no ill will to MSFT shareholders. A vast number of them, however, have been made very wealthy by MSFT abuses. I am also intrigued by how the market was manipulated Monday by the breakdown in settlement discussions. The most glaring insanity was that SUNX was down Monday. That is why I question whether RNWK will benefit in the short-term from the late afternoon ruling by Judge Jackson. The remedy will be a long drawn-out process, so the market will probably react slowly in general.

For now, though, I expect MSFT to get another whack on the market today. I just hope it doesn't irrationally facilitate market manipulation of QCOM and other stocks held by my friends here on the Porch.
