What are you going to say when Microsoft wins the appeal?

That would depend on the details. The former lawyer for Nixon's committee to reelect the president, Thomas Penfield Jackson has been known to make mistakes and has been overruled a number of times in the past. His biggest problem has been laziness, not surprising from a Reagan appointee I suppose, but this case seems to really have him animated. I doubt that Microsoft is going to win a major victory in the appeals court but they may be able to delay things long enough to see if Bush will save them.
