Sounds like they are saying they do not want any help from the Appeals Court that has readily ruled in their favor in the past???

Captain, I am sure they want it to go to the Appeals Court first. In order to get there, they have to give the appearance of wanting to fast track going into the remedy phase. If they show there is no problem in going this phase quickly, Jackson would not be able to justify as easily his plan to send it directly to the Supreme Court.
Furthermore, I don't believe MSFT will not comment on Jackson's ideas until they have a decision in the remedy phase.

I have a good idea (or an inkling) of what they would do just after the remedy phase but don't want to talk about it. I am not just talking about filing an appeal.

CJ: They agreed to expedite the remedy phase so they can get out of Jackson's court room. Jackson's desire to end run the Appellate step shows that he is afraid of being overturned. More and more he continues to act like a co-prosecutor and less a judge. This case will be thrown out on the basis of his conduct alone - never mind the off the wall findings of fact which in reality ignore the facts. The guy is nuts. He is on a power trip. A little man finding his moment in the sun in an otherwise dull and unproductive life.JFD
