I'm not so sure of that. Besides, unless this thing is settled, inevitably it will end up in the Supreme Court. Even if the D.C. Circuit Court of Appeals entertains the appeal and reverses or modifies the District Court's ruling, that doesn't mean the Supreme Court won't make inroads into any ruling by the Circuit Court.

Bottom line, regardless of whether the Circuit Court hears this thing, MSFT will have headaches for a long time to come.

Dear nihil: Frankly, what you say makes a lot of sense, except that I have to imagin that Judge Jackson knows what he is doing and surely had some private discussions before taking the step he did. Perhaps, they will argue its operating system is so pervasive in our society that it effects the vast majority of citizens or something like that to require the Supreme Court involvement. JDN
