Michael, I had to think about this one a bit, but since I have some new tennies with a similar feature to the one she's complaining about (if you can call a $10 million suit a complaint!), I think I understand her beef. Partly speculation here, but in the back of a shoe I own (a different brand, but apparently similar to her Nike shoes) there's a big loop at the top of the heel section (by achilles tendon) for you to hold on to help you put it on your foot. (The prior three generations' methods apparently stopped working and so this innovation was needed <g>.) Anyhow, while running, the loops of her laces simply lassoed this retarded protrusion and effectively tied her feet together while running. Obvious result: ker-splat! I'd say Nike has a big problem on their feet, er hands. On my shoes, my laces aren't flapping in the breeze like that, nor do my feet come close enough together, but some people nearly click their heels as they run ("there's no place like home; there's no place like a $10 million mansion; ouch!").
