Erik the operative word in your post is "minor" setback to SUNW. This news came out before the market on Friday and SUNW went up over $6 per share. Furthermore, consensus opinion is that SUNW will blow out 3rd quarter earnings numbers. So the significance of this "set back" is small. Furthermore, SUNW is looking at the possibilities of an additional JAVA lawsuit.

Eric, I haven't read the decision, but typically, the denial of a motion for summary judgment means that the court feels there is a "triable issue of fact or law" that cannot be resolved on papers.

The comment by the MSFT spokesman to the effect that "It's a step in the right direction to [proving] Sun violated its contract with us and is trying to harm Microsoft's ability to compete," sounds like a knee jerk reaction to Judge Jackson's decision in the antitrust litigation. Classic "pot calling the kettle black" syndrome. MSFT is getting very touchy. They should have just kept their mouth shut. Tec.

Dear Eric: OK, I will be honest, it PISSES ME OFF!! Here we got a Company (MSFT) that is VIOLATING not only the terms of the contract with SUNW but with the WORLD by trying to SCREW UP the JAVA language so that it will ONLY run on Windows operating system and this DUMBASS JUDGE says you gotta HELP THEM. He's got to have been BOUGHT OUT. JDN
