Steven, What both, you and PROLIFE say, is true about the poor unfortunate Hispanic people. One thing we should not lose sight of, though, is that they are entering this country illegally. The "operative" word being illegal. I can understand their need to flee the corruption and economical chaos of their country but, the INS rules must be changed before we can turn a blind eye to this migration. I might also add, that those coming across the Rio Grande are not only Mexicans but also Nicaraguans, Salvadorans, Columbians, etc., etc. And, make no mistake, they are NOT all alike in temperament. They are, literally, different kinds of Indians. There are large areas of the city of Houston now where only Spanish is spoken, much like Miami. What is the solution? I surely do not know.

You understand, I hope, that all Cubans caught at sea are returned by agreement to Cuba. Only those who make it ashore may claim asylum (just like the Mexicans). If Elian had been rescued by the Coast Guard he would have been returned to Cuba.

Sec. 208.(a) Authority to Apply for Asylum.-

(1) In general. - Any alien who is physically present in the United
States or who arrives in the United States (whether or not at a
designated port of arrival and including an alien who is brought to
the United States after having been interdicted in international or
United States waters), irrespective of such alien's status, may apply
for asylum in accordance with this section or, where applicable,
section 235(b).

There are exceptions, but for the ordinary undocumented alien, there are many opportunity to claim refugee status. The key is evidence that they have a well founded belief that they are in danger -- a letter from your mama (or Subcommandante Marcos) that policia were around looking for you for political offenses (no warrant) is usually enough I understand.
