SUMMARY NOTICE OF HEARING ON PROPOSED CLASS ACTION SETTLEMENT
TO: ALL PERSONS WHO PURCHASED IN THE PUBLIC MARKET COMMON STOCK OF
SYSTEMS OF EXCELLENCE DURING THE PERIOD BETWEEN DECEMBER 26, 1995 AND
OCTOBER 7, 1996, INCLUSIVE.
YOU ARE HEREBY NOTIFIED, pursuant to Rule 23 of the Federal Rules of Civil Procedure and an Order of the Court dated March 17, 2000, that a Settlement has been proposed in the above-captioned class action litigation (``Systems of Excellence') (OTC: SEXI - news).
A hearing will be held before the Honorable Lenore C. Nesbitt in the third floor Courtroom of the United States District Courthouse, Southern District of Florida, 301 North Miami Avenue, Miami, Florida 33128, at 10:30 a.m. on June 28, 2000, to determine whether the proposed Settlement should, in the amount of $1,034,000, be approved by the Court as fair, reasonable and adequate, and to consider the application of Plaintiffs' Counsel for attorneys' fees and reimbursement of expenses.
IF YOU ARE A MEMBER OF THE CLASS DESCRIBED ABOVE, YOUR RIGHTS WILL BE AFFECTED AND YOU MAY BE ENTITLED TO SHARE IN THE SETTLEMENT FUND. If you have not yet received the full printed Notice of Hearing on Proposed Class Action Settlement (``Notice') you may obtain copies of these documents by identifying yourself as a member of the Class and by writing to: Systems of Excellence Settlement, Notice Administrator, P.O. Box 1367, Blue Bell, PA 19422, (800) 222-2760.
To exclude yourself from the Class you must file a request for exclusion, as described in the Notice, so as to be received no later than May 30, 2000. IF YOU ARE A CLASS MEMBER AND DO NOT EXCLUDE YOURSELF YOU WILL BE BOUND BY THE FINAL JUDGMENT AND ORDER OF DISMISSAL OF THE COURT.
THERE IS NO CLAIM FORM TO BE FILED AT THIS TIME. YOU WILL BE CONTACTED BY THE SEC RECEIVER REGARDING THE DISTRIBUTION OF THE SETTLEMENT FUNDS.
