Confusion has been partially cleared up. Tern down only 3.

By the way, your info was already widely known and in the main stream media.

Steve-

Thank you for your even handed and absolutely
fair approach to TERN. It's amazing hearing the TERN
Exec's try to weasel out of direct question on the
"cease and desist" letter, as well as other questions
being asked of them.

I have rarely seen a less forthcoming public company,
and I believe the market tomorrow will reflect this.

Skane

P.S. Lehman Bros. nailing them to the wall re: Cease
and Desist letter, calling them liers

Mark --

I hadn't seen the letter before but based on what's included in TERN's SEC documents, I think it would behoove their attorneys to have it included in future filings. As it stands, the wording gives a far different slant.

I would also think their attorneys would insist on their website being changed as they still have their co-authorship of DOCSIS 1.2 listed in the company description. While it may have been true at one time, it gives a false impression now.

I would note their last SEC filing, the 10-K, did not delineate their relationship with Rogers Communications. Since it appears they did not extend their alliance beyond the first year, ending on March 31, 2000, I would think a paragraph explaining the changed relationship would be in order.

These points may appear petty --- and for the casual investor I suspect they are --- but class-action attorneys may see it differently.

Thanks again for posting the link.

Pat

TERN MAKES NO DOCSIS MODEM - THEY JUST RE-SELL A TURBONET REPACKAGED MODEM...

WHY DON'T THEY TELL THE SHAREHOLDERS THIS?

BECUASE THE MODEM IS THE SAME MODEM THAT TURBONET RE-PACKAGES AND SELLS FOR TOSHIBA, COM21 & BESTDATA - and the margins are terrible?
