I hadn't seen the letter before but based on what's included in TERN's SEC documents, I think it would behoove their attorneys to have it included in future filings. As it stands, the wording gives a far different slant.

I would also think their attorneys would insist on their website being changed as they still have their co-authorship of DOCSIS 1.2 listed in the company description. While it may have been true at one time, it gives a false impression now.

I would note their last SEC filing, the 10-K, did not delineate their relationship with Rogers Communications. Since it appears they did not extend their alliance beyond the first year, ending on March 31, 2000, I would think a paragraph explaining the changed relationship would be in order.

These points may appear petty --- and for the casual investor I suspect they are --- but class-action attorneys may see it differently.
