--11:30 am Gemstar continues to weaken
Shares of Gemstar (GMST: news, msgs) are off 8.3 percent to 50 55/64, continue a month-long slide that has shaved 40 percent off the company's market cap. In the same time, the Nasdaq Composite ($COMPQ: news, msgs) dropped some 12 percent. In a research note, Chase H&Q analyst Joe Arsenio said the sell-off came on "unjustified recurring fears regarding the completion of the TV Guide acquisition." A pair of senators recently wrote a "letter of concern" to the DOJ about the acquisition. Arsenio said he expects the deal to close next month rather than this month. He reiterated his "buy" rating and kept Gemstar on the bank's "focus list."

"We believe yesterday's abrupt sell-off in GMST's shares reflects a generally poor market for technology companies and unjustified fears regarding the completion of the TV Guide acquisition."

"Yesterday we held discussions with the management of both GMST and TVGIA and believe that the merger continues to be on track, but is now expected to close in May rather than April. We do not believe that these senators (DeWine and Kohl) have the authority to derail the merger process and that their letters were submitted too late in the process to have any material effect on the DOJ's decision."

"Significant guide related advertising revenues appear to be just around the corner with the primary gating factor being the integration of both company's installed base into one consolidated advertising network. Subject to completion of the merger, we believe a sharp ramp-up in advertising sales may begin as early as June, and no later than the September quarter."
