I continue to believe that bad news for TERN will weigh heavily on CMTO and anything short of terrific earnings may not stop the slide. Still holding, but concerned.

Your analysis is excellent, as always.

I agree there are many astute investors from both camps who will be comparing companies and technologies going forward. As for insider sales during the January to February time frame, and the absence of any public statement regarding the CableLabs "cease and desist" warning, not only would Terayon have known about CableLab's decision before the Feb. 2 letter was received, they were making every effort to maintain their public persona regarding DOCSIS influence. Shareholders were not told about the new status --- bad enough in itself --- but also encouraged to believe the earlier alliance was intact.

A quick glance at what was said in their Q4 CC shows Rakib stating emphatically that they would have a proto-type in trials by mid-year and DOCSIS approval by the end of the year. As recently as a week ago they maintained their 1.2 DOCSIS authorship position on their website. And when Gilder's report came out, they posted quotes from the report and then a day after the issue was discussed here on-line, they took them down. It appears they've walked a thin line on every front and pulled back only when caught.

From last Q's conference call:

Q: Clarify issue of DOCSIS and S-CDMA being accepted, time line, and how it's limiting US customer base.
A: Refer to CableLabs letter --- proto-type by mid-year and approved by end of year. Make no mistake this is advanced certification that includes S-CDMA. The US is in transition. Penetration is a function of how fast you have DOCSIS. Once we have 1.1, we have opportunity for accelerated penetration. Some cases need proprietary and will move to DOCSIS.


From yesterday's CC:

On track for 3Q for prototype to cablelabs. Based on Advance CDMA and TDMA. Both CPE and head-end based on our chip set. CMTS --- quality-based on 1.0. At CableLabs now. Part of current wave. No committment to whether we'll pass.


I haven't figured out if Zaki is brilliant at confusing the issues or just plain sloppy. It's often very difficult to decipher whether he's talking about the OEM DOCSIS product or the one they're developing in-house.

At any rate, after being in CMTO for nearly two years and surviving some serious "dips," I've learned to hold strong through the volatility and take advantage of market mutability whenever possible.

Now, there's some good news to hold onto: AMD earnings. Concensus was .57. They made 1.15!!! I'm building an altar to the AMD gods as we speak. :)
