Quincy. this issue was fully dealt with on several occasions. your claim of my assertion and what was actually stated are two separate events.

my assertion was that the previous agreements between IDC and Qualcomm would need to be reworked to include all aspects of the third generation standard. it would be fair to say that those past agreements, subject to their limitations would not apply to current assymetric data formats or all inclusive fdd spreads.

why is this hard to accept? obviously attorneys will develop different views on the same subject. i believe it is clear though (or will be made clear) that a new agreement will need to be generated.

Good question Quincy, but one that Darrell has refused to answer. If you look in IDC's most recent 10K, you will find that IDC management apparently felt it necessary to specifically state that the agreement does extend to 3G. They hedge this by saying there are some limitations, however I take this to mean the widely acknowledged 10Mhz limit, etc. not that the QCOM/IDC agreement is somehow weakened just because it is being applied to '3G'.

Of course Qualcomm claims the IPR isn't even necessary but an agreement was made to avoid litigation. The almost free $5 million payment seems to support this. If the patents were necessary to Qualcomm for IS-95 and 3G then IDC acted irresponsibly to shareholders by selling something that has allowed billions in sales for such a small one-time payment.

I just checked the Dalglish IDC promotional website and he still has not corrected that erroneous statement. I alerted him to it months ago. I guess he's not too concerned about liability claims.

Quincy, as you may be aware the 3g spectrum auctions in Japan included both TDD and FDD.

proposals put forth by ARIB include a buildout of the TDD framework as well as FDD for DSS. it is in these TDD based assymetric data requirements that IDC's IPRs are well established for handhelds. if Q has designs to move into a development posture for TDD, this would be one more area in which IDC and Q would need to negotiate for intellectual property transfer
