It is not that their lawyers are incompetent, sometimes there is no credible defense to patent license violation. Hitachi is basically saying that RAMBUS stole the JEDEC proceedings and patented them. The problem with that is that the patents in question were submitted in 1990 and 1991 well before the JEDEC meetings. It is obviously impossible. I expect that Hitachi will eventually see the light. The scuttlebut is that they do not like to pay royalties on any patents.
