It is the best that they could come up with. It will receive some attention by court to see if it has any legal merit. But on its face it is a very week defense. All RAMBUS has to do is show that all the elements of its patent were disclosed at the outset. The continuation patents just breakdown those elements into manageable chunks and allow the claims to be written such that they delineate the bounds of the invention.

Hitachi also said (I believe) that they had rights to the patents because RAMBUS attended some of the JEDEC meetings. This also seems to be a very week defense.

I expect that Hitachi will settle eventually maybe on the steps of the court house. Any other action risks putting them out of business in major market sectors.

By the way, I did not say that the case was in the bag. No case ever is in the bag until it is in the bag.
