Don't you think it's ironic that when you play with fire you get burnt? I think the mere fact that you had to publish a retraction harmed your credibility in a way that a dismissal on a "technicality" will not reverse.

Maybe you should evaluate your tactics. I do believe that there are scams that are there to be revealed and upon which legitimate profit can be made. I would support you in that regard, but your approach is where I find questions that border the rules and regs of the trading environment.

If it is proved that someone acting in the guise of a "reporter" or "fact finder" is merely a tool for selective leakage, followed by trading before that supposed "news" comes public, then all the issues which have concerned me will be on the table. The fact that one entity has no position that one can prove in an equity, will not insulate that entity from potential liability, whether that liability be civil, criminal or administrative. If that is the case, the issues raised by the ZiaSun lawsuit will seem very minor by contrast.
