Dan:, the key word in my statement that you quote is "materiality." Regardless of the ultimate inclusion or exclusion of S-CDMA in DOCSIS now or in the future, the threshold question to ask is whether such information flowing between CableLabs and TERN prior to the information being made public was sufficiently material to an investor that he would want to know such information before making an investment decision. There seems to be a lot of investors, or shareholders of TERN stock, who think so, and as a consequence have filed a class action against these selling shareholders.

Yes, freedom works. Unless this lawsuit(s) is settled somewhere along the road, which is likely, each party will have their day in court.

But bullish analysts say that Mr. Chanos and other short sellers
have overplayed their hand on this crucial issue. Terayon already
has a Docsis-certified modem that uses TDMA technology, and
the company has a good chance of winning CableLabs' approval in
the near future for a modem that will use both CDMA and TDMA
technology. More important, the company is establishing itself as
a leader in the huge Asian cable market, having recently won
important contracts in China and South Korea.
