Maybe and maybe not,

It's obvious that Cablelabs was satisfied that it was a matter of interpretation rather than a purposeful attempt to blatantly deceive. Cablelabs could have demanded TERN change their ways(and they did ask for that as it is) while concluding there WAS prior intent to deceive. They didn't conclude there was intent to deceive, and I doubt a court will either. There would be no case if Tern's guy's believed in their own innocence all along, are aware that they intend to submit S-CDMA for DOCSIS as planned, are aware that the invitation to submit was NEVER taken away by Cablelabs, and believed the correspondence would never become a public issue, IMO. By the by, if S-CDMA is accepted, TERN is surely aware Cablelabs would likely issue a release number upon S-CDMA's inclusion, just as was the case when it was previously given the specific designation 1.2.

I suspect the above is the likely truth. I could be wrong.
