I suspect a custody hearing would cause the boy to be returned to the father also. However, had she successfully emigrated to the US, custody would have likely been granted to local relatives especially if she had drafted a will, living will, or some agreement on custody arrangements in the event of her death or incompetence.

Not in the case that the surviving parent is a child molester and murderer, such as is the case with Fido Castro and his retarded thugs.

Since Castro and his thugs OWN all kids, and they are obviously not fit parents, the custody of the child, Elian, should go to the relatives that saved his life, and kept him out of the clutches of Fido's corrupt government.

Elian deserves to be free, and has earned the right to live with his wonderful and caring Miami Cuban family.
