The court obviously found strong reasons to let Elian continue to stay in the U.S. and have his day in court.

"The existing INS regulations do envision situations where a minor may act on his own in immigration matters"

This was obviously known by both Reno and Meissner, hence their haste to not let him have his day in court. There is no age based restriction for a Cuban kid to seek asylum in the U.S.

The law is clearly on the side of Elian.
