Exactly. It is ironic that the same group of Scalia conservatives, who believe in strict construction of the Constitution, would stand behind that tenuous decision. Since what period in American jurisprudence have 6 years olds been given the power to decide anything over the wishes of a fit parent? A 6 year old can't even sign an enforceable contract, how can one make a decision about where to live? Purely political. And look who suffers, a little kid. How 's sad is that. To them it's all about preventing Clinton's "legacy". To the Exiles it's about screwing Castro. America has witnessed few fiascoes more embarrassing .

That's about the only intelligent thing you have said so far.

There has been great certitude among the Send-Elian-home crowd about the clarity of the law in this case; everyone should consider themselves lucky the 11th Circuit issued its opinion of what the law requires here. Otherwise the Clinton Administration's cops would have grabbed Elian and stuffed him onto a plane for Havana with Fidel's thugs and their other prisoner, Juan Miguel Gonzalez.

Good thing that politics restrained the thugs until the Courts could act.
