you are right, sorry. I somehow thought that their investment gains in the year ago quarter would be small and did not check. I suspect that last year's gains were so large because their stock was rising, and they are known to sell puts on their stock as part of their continuous stock buyback program. This year's gains on the other hand were probably largely due to sales of investments in their portfolio. In any case, it seems to me that neither of these avenues of propping up their earning will be available in the near future, if the tech bubble deflates, and MSFT stock remains in the doldrums.

It's been a long time since law school for me, and I never practiced. But, dmp can explain how easy it is for plaintiffs to smoke MSFT now that a judge has already ruled on the facts. That is, unless MSFT wins on appeal.
