Once Elian is in the home of the Cuban diplomat, it's not up to the US government to allow Ms. Gonzalez contact, it's up to Elian's father and the Cuban diplomat. I found a copy of the 11th Circuit order on the website of the Miami Herald, unfortunately each article doesn't have its own URL, but if you go to the Elian full coverage page, it's under the Wednesday, April 19, 2000 header. The 11th Circuit wasn't silent about custody, they expressly declined to rule. And they did NOT say that Lazaro was Elian's guardian, it says he's Elian's next friend, which means he has the capacity to file the suit on Elian's behalf. Read it for yourself. herald.com
