There is no doubt about it, you've plainly shown the false premise he offered. His recommendation is thus based in part on an incomplete representation of Terayons products, a representation which is itself central to his otherwise compelling argument to sell. This is not a matter of opinion. It is not a question of margins or any other issue. It is strictly a matter of false information having been offered as a basis for a published recommendation.

Astoundingly, as I've previously noted, it is clear he was aware of at least the particularly relevant portion of the true extent of Terayons product offerings prior to publicly disseminating his very official looking "Pluvia Securities Report" to the SI community- as he had in the past indeed criticized the potential profitability of Terayons DOCSIS certified modems in ordinary posts.

This would clearly amount to intentional fraud, save if an innocent mistake on his part could be established, among other things.

His Pluvia Securities Research report on Terayon is roughly akin to saying Pepsico sells products solely based on strawberry, a flavoring. Cola products, an industry standard pop in the United states, must be developed to successfully compete in the United States market. If strawberry doesn't become the industry standard, Pepsico is left with strawberry, for which there is minimal market, thus a strong sell recommendation on Pepsico is advised.

---The most significant difference being that in the Pepsi example, reasonably expected common knowledge would mitigate, and cause the average readers to immediately recognize a joke when they see one.
