The Declaration of Independance is a political document proclaiming, as the title says, that some of the British colonies in North America are not under control of the British government. It is not a legal document (as it does not by itself have the force of law). It is instead the Treaty of Paris which carries the legal framework for the independance.

The Constitution however is the primary legal document of the United States. It is clearly based on the separation of powers so as to not allow any one group to obtain and retain complete control over the government. As a condition of it's ratification the Bill of Rights was ammended to it with a guarentee of freedom of religion. There can be no freedom of religion without also having a freedom from religion.
