I would tend to disagree - unless one is greedy, I don't see why someone who shorted at 10 wouldn't cover at 3 - there are other opportunities out there - and you would still be subject to capital gains (one doesn't have to close a short position by year end - it is market to market for tax purposes and "unrealized" gains are paid ro IRS)
