Connecticut Attorney General Dick Blumenthal told me the Justice Department and the states are keeping in mind shareholder value as they craft a remedy.

I can hear one State AG saying to the gathered group of 19. "Hey, lets encourage shareholders to file a class action lawsuit against the company to recoup losses in the value of their stock." Thunderous applause erupts from the attentive group.
A second AG speaks up "Great idea, and hey, let's agree that any funds awarded in those lawsuits will be a non-taxable event in our states." Another uproar ensues.
A third thoughtful AG interrupts and voices concern. "Wait a minute, you all know any proceeds that the shareholder may receive as a result of litigation will be a mere pittance and most of the money will end up in the hand of the lawyers." This shocks the assembled AG's in disbelief and the room becomes quiet.
An elderly AG who has years of political experience patiently turns to the concerned AG and says. "Don't you get it, not only will the shareholders think that we were trying to help them. But we also attain the added benefit of a grateful trial lawyer association for allowing them to reap a tremendous windfall in fees from damages awarded. That my concerned friend is our ultimate victory. A grateful lobby group that will help you get elected in your next election endeavor."
The concerned AG now realizes the magnitude of what will transpire and gleefully asks the assembled group. "Never in my wildest dreams did I realize the end game to this litigation. I see the light, this is great. OK what company is our next victim?" <vbg>
