I doubt that. Rather, I suspect that the media will ignore him - which to him is the ultimate insult. Remember, the media trumpeted every unfounded charge and bogus armchair psychological profiling against the family and Elian. Clinton and Reno are the ones that need examination because their acts confound not just the law but reason. Once again, reports are that the FBI was against their armed raid and kidnapping.

I respect Dershowitz, he is brillant imo, and he has never ever claimed the boy does not belong with the father.

I doubt that Alan Dershowitz said this. He may agree that Elian could apply for asylum. If you would note in the brief filed by the INS, the govt. seems to be side-stepping this issue. The INS is arguing that Elian did not request asylum. They will win on this point - Elian is going home with dad. Dershowitz is a professor. As a prof. he is more interested in arguing the academic details of the law rather than the practicalities. That is why what he was actually arguing, before you took it out of context, was that a child could petition for asylum without the permission of a parent. Beleive me, this issue will dissappear as fast as a case of beer in Lazaro's fridge on a Saturday night. Why? Because those 2 cent lawyers that the exiles had representing Elian will be fired by the boy now that he is not under their influence. They will have no legal voice at all, no matter how many 7-11s they shut down.
