If Elian is a citizen of Cuba the custody issue belongs in a Cuban court. If this boy is a citizen of Cuba who should not be applying for asylum then his custody is a matter for his home country to decide. I have NO idea why an American court should decided what is in the best interest of a Cuban child. Seems to me the ONLY issue for our courts is whose citizen is Elian? As far as I can tell drowning at sea does not make his mother eligible for citizenship- no matter how worthy her flight to freedom with the child she apparently kidnapped. So mom and dad are both Cuban citizens, child would be a Cuban citizen IN Cuba but for the actions of his mother- if her actions in taking the boy were criminal- if she kidnapped him, by making Elian a citizen, we reward a criminal act. Further, we allow a criminal action by one parent to sever the paternal rights of Elian's father. None of this seems to be good public or foreign policy to me.

It seems obvious to me that NO minor child should be granted asylum in the US against the wishes of a living biological parent. I mean if you want parents to consent to abortions for their minor children (as SO many do- who are all for changing the citizenship of Elian)I sure as HELL hope you want them to consent to asylum- EVEN if they live in communist countries.
