Much confusion surrounding the matter, isn't there? I was just watching Bill Bennett on Hardball, he was opining that Juan Miguel's rights in the matter were somehow lesser because he thought Elian lived with his mother. When Chris Matthews corrected him, the dad had a much bigger house, he stayed most of the time with his dad (not to mention the fact that both worked, but Dad was remarried, and Mom worked longer hours) then Bennett kinda sputtered out.

But the law doesn't say how old you have to be to apply for asylum, it says "any alien regardless of said alien's status" and age is a status. So that's why the case is proceeding, that's what the 11th circuit ruled on.

Where did the age 12 thing come from, I am not following the thread, and it's not in anything I've seen. Definitely the way the case stands in the 11th Circuit, age doesn't matter. I've printed out the opinion. (Isn't it wonderful? We don't have to listen to people garble stuff anymore, we can go straight to the source. I've got the warrant, too.)
