While it is not in and of itself legally mandated, it is fair to say that in courts of law (as it has been a staple of arbitration and mediation proceedings for some time) it is increasingly customary to state in contracts - or, in the absence of a contract, for damages to be assessed - taking into account the prevailing parties' legal costs and fees.

Simply stated, while not a "rule," it's something that is done more and more, by choice or convention.
