I'm not sure of that now. Increasingly it looks like Clinton's and Reno's rogue abuse of power may be the one thing that actually saves Elian.

Without the huge abuse of power by Clinton and Reno for political purposes the odds were that Elian would eventually go back to that Castro-devastated island. Now there is probably a greater chance that the courts will rule in favor of Elian as they recognize what Clinton and Castro are planning for the boy.

I wouldn't say it's a sure thing but the odds are getting better for Elian the more the courts act to secure the rule of law and justice; and to defeat the use and ends of raw political power that Clinton and Reno tried to substitute in their place.
